Welcome to ToonBee. ToonBee is developed and created by Insta App SRL. By accessing or using our AI-powered cartoon video generation service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

1. Service Description

ToonBee is an AI-powered platform that allows users to generate custom cartoon videos, animations, and images on demand. Our service includes:

• AI-generated cartoon video and image creation
• Access to pre-generated content library
• Commercial usage rights for generated content
• Various export formats and customization options

2. Account and License

2.1 Account Registration

To use ToonBee, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 License Grant

Upon purchase, ToonBee grants you a personal, non-exclusive, non-transferable license to:

• Generate unlimited AI cartoon videos using our platform
• Download and use generated content for personal or commercial purposes
• Use content in client projects, advertisements, social media, websites, and other media
• Modify, edit, and incorporate generated content into your own works

2.3 License Restrictions

You may NOT:

• Resell, redistribute, or sublicense the generated content as standalone stock footage
• Share your account credentials with others
• Use the service to create illegal, defamatory, or harmful content
• Reverse engineer, decompile, or attempt to extract the source code
• Use automated systems to generate excessive content for resale purposes
• Claim the AI-generated content as exclusively your own copyrighted work

3. Commercial Usage Rights

All content generated through ToonBee comes with full commercial usage rights, which means:

• Client Work: You can use generated footage in projects for paying clients
• Marketing: Use in advertisements, promotional materials, and social media campaigns
• Products: Incorporate into products you sell (courses, templates, videos)
• Broadcasting: Use in TV, film, streaming content, and online videos
• No Attribution Required: You don't need to credit ToonBee (though we appreciate it!)

Important: The generated content may not be unique to you, as other users might generate similar content using similar prompts.

4. Payment and Refunds

ToonBee offers a one-time payment for lifetime access. All payments are processed securely through our payment partners. For our refund policy, please see our Refund Policy.

4.1 Fair Use Policy

Our AI credit packs are designed for normal business and creator usage. If an account falls within the top 0.01% of usage compared to other customers, we reserve the right, at our sole discretion, to limit service, cancel access, and issue a refund for unused or recently purchased AI credits.

This policy helps us keep ToonBee sustainable and reliable for all users. If your usage appears unusually high, we may contact you to discuss suitable options before taking action.

5. Content Generation and Quality

5.1 AI-Generated Content

ToonBee uses advanced AI technology to generate content. While we strive for high quality:

• Results may vary based on prompt quality and complexity
• Generated content is created by AI and may occasionally have imperfections
• We do not guarantee specific results or outcomes
• Content quality depends on various factors including prompt clarity and system load

5.2 Content Ownership

You retain rights to the generated content for your use as outlined in these Terms. However, ToonBee retains ownership of the underlying AI models, technology, and platform.

6. Prohibited Uses

You agree not to use ToonBee to generate content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, discrimination, or harassment
• Depicts illegal activities or violence
• Contains explicit adult content or nudity
• Attempts to impersonate real individuals without permission
• Spreads misinformation or deepfakes intended to deceive
• Violates privacy rights of others

7. Service Availability

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free service
• That the service will meet your specific requirements
• That all features will be available at all times
• That generated content will be free from defects

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

8. User Content and Data

8.1 Your Prompts

When you input prompts to generate content, you grant ToonBee the right to:

• Process your prompts to generate content
• Use anonymized prompt data to improve our AI models
• Store your generation history for your account access

8.2 Privacy

Your use of ToonBee is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Intellectual Property

All rights, title, and interest in ToonBee, including the platform, website, technology, AI models, and branding, are owned by ToonBee and its licensors. These Terms do not grant you any rights to our trademarks or branding.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ToonBee disclaims all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• That generated content will meet your expectations
• That the service will be uninterrupted or error-free
• That defects will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOONBEE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the service
• Any content generated through the platform

In no event shall ToonBee's total liability exceed the amount you paid for the service.

12. Indemnification

You agree to indemnify and hold harmless ToonBee and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of others
• Content you generate or how you use it

13. Termination

We may terminate or suspend your access to ToonBee immediately, without prior notice, if:

• You breach these Terms
• You engage in prohibited activities
• We are required to do so by law
• We decide to discontinue the service

Upon termination, your right to use ToonBee will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the platform. Your continued use of ToonBee after changes are posted constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where ToonBee operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of ToonBee shall first be attempted to be resolved through good faith negotiations. If unsuccessful, disputes may be resolved through binding arbitration in accordance with applicable arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ToonBee regarding the use of our service.
